Fonds consists of documents concerning the John By estate including the account book of the trustees for the sale of the estate, 1865-1877, petition, 1876 and Judgement by Chief Justice Sir W.B. Richards, 1978, surveyor's report, 1861, and two ledger books listing accounts with heirs, 1859-1873 and 1873-1888. Inscription in memory of Lieutenant Colonel John By, St. Alban's Church, Frant, Tunbridge Wells and photographs of plaque at St. Alban's Church and at Shernfold Park, Kent, on microfilm, reel A-1982.

The fonds also contains a plan of Bytown, printed and coloured to show the By estate, 4 December 1842; and a map entitled, "Survey of Land Taken for Canal Purposes", 5 April 1861.

By, John, 1779?-1836 : John By was educated at the Royal Military Academy, Woolwich, and received his commission as 2nd lieutenant in the Royal Engineers in 1799. He first served in Canada from 1802-1811. In 1826 he returned as a lieutenant-colonel for the specific purpose of designing and constructing the Rideau Canal from Bytown to Kingston involving 50 dams and 47 masonry locks. Upon the completion of the Canal in 1832 he returned to England where he remained until his death in 1836.

In 1832 Colonel By purchased a tract of land from Grace McQueen in the area that is now downtown Ottawa. Colonel By left no direct heirs, and the property was eventually divided among ten heirs. From 1861, the estate was sold for building lots. Between 1862 and 1878 the heirs of Grace McQueen and John By tried unsuccessfully to recover a portion of the estate which had been expropriated but not used for the construction of the Rideau Canal.
