He was appointed a permanent 3rd Class Clerk the following year and was transferred to the Department of Indian Affairs on its establishment in 1880. He served as Keeper of the Records, and was elevated to the position of Assistant Secretary in the Secretary's Branch in 1898. By Order in Council of 29 June 1905, Stewart was appointed one of the two federal commissioners (the other being Duncan Campbell Scott) who, along with the commissioner representing the Province of Ontario, Daniel McMartin, together negotiated Treaty 9 with the First Nations of northern Ontario. Stewart participated as Treaty Commissioner in the negotiations of Treaty 9 carried out in both 1905 and 1906. In 1908, he returned to the Treaty 9 area to negotiate a resolution to the problems associated with the adherence of the Abitibi Band to the treaty, occasioned by their location part in Ontario and part in Quebec. Stewart was superannuated 1 October 1919.
