Series consists of Court Challenges Program case files. The Court Challenges Program relied on a single operational filing system that was used to organize the cases of individuals applying to the Program for funding. Each application was assigned a file number and placed in a file jacket, regardless of whether it was accepted or rejected. The files date from 1985 until 1991 and cover a broad range of cases relating to language and equality issues such as: sexual, racial and language discrimination.

The case files were recently divided by the Program's staff into two separate yet related series - the public documents and the confidential files. This filing scheme was introduced in order to provide researchers with access to the documentation that was created and accumulated by the Program. There are therefore, in some instances, two files that document those cases that generated both confidential and public documentation. Since the rejected cases would not have produced much public documentation, the majority of case files in this series were those that received funding by the Program.

The majority of the public files were those cases that were either controversial and/or set a legal precedent in the area of language or human rights. The public files contain documents such as: court transcripts, news releases, reports regarding the issue that was under dispute, copies of pertinent legislation relating to the case and committee proceedings. These files also often contain the following type of court documents: notice of motion, affidavits, court orders, statement of claim, statement of defence and decision of the court.

Canadian Council on Social Development. Court Challenges Program : The Court Challenges Program was established in 1985 by a Memorandum of Agreement between the Government of Canada (acting through the Department of the Secretary of State) and the Canadian Council on Social Development (CCSD).

The Program, an autonomous body, was administered by the CCSD and was funded by the Secretary of State. The Program's mandate (originally scheduled to last five years) was to select cases and allocate funding to groups or individuals who wished to attempt test cases in the areas of language and equality rights. Rather than promoting court action, the Program sought to clarify the language and equality provisions of Canada's constitutional documents (for example, the Charter of Rights and Freedoms) through the courts. As well, it attempted to promote the importance of language and human rights throughout Canada. Finally, the Program provided minority groups with access to financial and human resources that would enable them to pursue their cases, if necessary, up the Supreme Court of Canada. The Program supported important, controversial and often precedent-setting cases that might never have been tried had it not been for the Program's support.

In 1990 the Department of the Secretary of State renewed the Program for an additional five years, and appointed the Human Rights Centre at the University of Ottawa as the new administrative body. In 1991, however, the federal government abolished the program, and appointed an administrator to wrap up any outstanding cases.
