Series consists of operational and subject files created and/or maintained by the Legislation Section of the Department. The mandates of this section include drafting federal government bills, drafting or reviewing federal regulations, harmonizing federal legislation with the civil law of Quebec, and publishing federal legislation and related tables. Legislative counsel of the DoJ draft all government bills and most regulations, whatever the sponsoring department or agency. They also provide legal and legislative policy advice to the departmental or agency officials in the course of the development of legislative proposals. As part of their work, legislative counsel review government bills and regulations for consistency with the Canadian Charter of Rights and Freedoms and the Canadian Bill of Rights. Legislative counsel also review draft regulations under the Statutory Instruments Act to determine whether they are authorized by their enabling statute and ensure they meet drafting standards. Because Canada has two official languages and two legal systems for private law matters, its legislation must be sound bilingually and bijurally, and the work of the Branch helps to attain these objectives. Canada. Dept. of Justice. Legislation Section : The Legislation Section of the Justice Department was established in 1946 to prepare the legislation in co-operation with other departments and to provide planning and co-ordination of legislation being considered by Parliament. The Legislation Section is responsible, by Cabinet authority, for the drafting of all Government bills. The drafters of the Section draft bills authorized by Cabinet or the Prime Minister. They also draft the motions to amend that the responsible Minister may propose during the consideration of the bill by Parliament. At the stage of policy development, drafters provide advice on both formal and substantive legal questions to the departmental officials responsible for preparing legislative proposals.

The Chief Legislative Counsel acts for the Minister of Justice in certifying the consistency of the government bills with the Canadian Bill of Rights and the Canadian Charter of Rights and Freedoms. The Section is responsible for reviewing each bill for such consistency.

The Tax Counsel Division to the Department of Finance includes a satellite unit of drafters of the Legislation Section located on the premises of that department. That unit works on tax bills and other legislative initiatives of that department. RG13 General Inventory
