Canada. Royal Commission Appointed to Investigate the Activities of the Canadian Performing Rights Society, Limited, and Similar Societies : The Parker Commission was appointed on March 22, 1935, by Order in Council P.C. 738 under Part I of the Inquiries Act (R. S. C., 1927, c. 99) and on the recommendation of the Secretary of State. Its sole commissioner was James Parker. Hearings were held in eight cities from April 9, 1935, to July 19, 1935 (33 days spent in hearing evidence). In total, 143 witnesses appeared before the Commission and 274 exhibits were filed. The cost of the inquiry was $17,701.18.

The purpose of that Commission was to investigate the following allegations: if the societies in question unduly refused to grant permission to perform musical and musical drama works, and if the royalties due when those licences were granted were excessive.

The report dated October 29, 1935, was tabled in the House of Commons on February 27, 1936, as Sessional Paper No. 113-1936. It was printed as such: Report of His Honour Judge Parker, a commissioner appointed by the Inquiries Act and the Copyright Amendment Act of 1931, pursuant to Order in Council no. 738, dated March 22nd, 1935. (Ottawa, J. O. Patenaude, I. S. O., Printer to the King's Most Excellent Majesty, 1935).

The report indicated that the Canadian Performing Rights Society, Limited (CPRS), as the sole society of its kind in Canada, acted as a licensing monopoly for the use of musical and musical drama works, the terms of use and the royalties due. Furthermore, the report established that the CPRS catalogue contained little or no works from Canadian authors and composers (given that its catalogue had been inherited from American and English societies who owned almost all of its shares), which interfered with the acknowledgment of their rights and the popularization of their works. The report also recommended the amendment to the Copyright Act to add the creation of a formal appeals tribunal to resolve disputes between users and the CPRS and to review CPRS tariffs on request before they took effect.
